Agreement
These terms govern your use of the VineWynd website ("the site"), operated from Melbourne, Victoria. By using the site, joining our waitlist, or submitting information through our forms, you agree to these terms. If you are submitting information on behalf of a winery or other business, you confirm you are authorised to do so.
About the site
The site is a pre-launch information page for the VineWynd platform. Content on the site, including descriptions of features and launch timing, is provided in good faith but may change as we build. Joining the waitlist does not guarantee access to any beta or product, and submitting a winery does not guarantee a listing.
Our content
The VineWynd name, logo, brand, and the content and design of this site belong to us or our licensors. You may not reproduce or use them for commercial purposes without our written permission.
Winery submissions
When you submit information or photos about a winery, you promise that the information is accurate and that you own the photos or have the right to share them with us, including any people identifiable in them. You grant VineWynd a non-exclusive, royalty-free licence to use, reproduce, adapt, and display your submitted content on the VineWynd platform and in reasonable promotion of it. You keep ownership of your content, and you can ask us to remove it at any time by emailing us, which we will do within a reasonable period.
Acceptable use
You agree not to use the site unlawfully, submit false or misleading information, upload content that infringes anyone's rights or is offensive, or interfere with the operation or security of the site.
Third-party services
The site relies on third-party services, including our hosting provider, and may link to external websites. We are not responsible for the content or practices of third parties. How we handle your personal information is described in our Privacy Policy.
Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee or other right you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, the site is provided "as is", and to the extent permitted by law we are not liable for loss arising from your use of the site or reliance on its content, and our total liability is limited to resupplying the relevant service.
Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
